Superfund is the common name for the federal government program enacted to clean up uncontrolled hazardous waste sites across the nation. The Comprehensive Environmental Response, Compensation and Liability Act (CERCLA) was established in 1980 and there are currently 13 designated Superfund sites in New York and New Jersey due to asbestos pollution or contamination.
There must be a current or threatened release of hazardous waste or substances for a site to be added to the National Priorities List designating the site for Superfund cleanup. These sites, primarily designated by the Environmental Protection Agency (EPA), can start the complex process to begin cleanup once designated. The EPA begins to create plans for cleanup and pushes responsible parties to implement the removal plans or reimburse the government for EPA lead cleanups. This process can take years before the removal process can begin.
Superfund sites are prioritized after an initial assessment of sites and ranked by the Hazard Ranking System based on the potential of a given site to pose a threat to the public or to the environment. Asbestos-related sites that threaten public health are addressed at a high priority.
